In accordance with our anti-corruption code of conduct, as well as with the legislative and regulatory provisions in force, this platform enables you to file reports and carry out secure exchanges. It is accessible to all RTE employees and third parties. It allows anonymous reports.

Important

This outsourced platform allows the submission of reports from :

  • employees of the company and its subsidiaries concerning the existence of conduct or situations contrary to the anti-corruption code of conduct
  • any natural person who reports or discloses information concerning a crime, an offence, a threat or harm to the general interest, a violation or an attempt to conceal a violation of an international commitment duly ratified or approved by France, a unilateral act of an international organisation taken on the basis of such a commitment, European Union law, a law or regulation. Where the information was not obtained in the course of professional activities, the whistleblower must have had personal knowledge of it.
  • any person concerned who reports the existence or realisation of risks to human rights and fundamental freedoms, the health and safety of individuals or the environment.


Excluded from this system are facts, information or documents, whatever their form or medium, the revelation or disclosure of which is prohibited by the provisions relating to national defence secrecy, medical secrecy, the secrecy of judicial deliberations, the secrecy of judicial enquiries or investigations or the professional secrecy of lawyers. 

In compliance with the law, this system in no way replaces the rules in force at RTE and its subsidiaries, but is part of, and complements, the internal framework of employer/employee relations in compliance with the obligations of the French Labour Code. Employees may benefit from mediation measures prior to or as an alternative to this scheme; in terms of psycho-social risks, a network of Correspondents or Referents* is available to employees concerned (victims or witnesses) in the regions and at national headquarters. Similarly, the system does not replace referral to the judicial authorities in the event of a criminal offence.


All potential users of this system are free to decide whether or not to make use of this option, but it is available to them as soon as they consider that alerting the authorities is the most appropriate way of reporting an incident.


Whistleblowers must act without direct financial consideration and in good faith.

*Your Quality of Life at Work correspondent, whose job it is to receive such reports and who is trained to do so, as well as the prevention officers;

  • RTE's Sexual Harassment and Sexist Behaviour Officer, who is responsible for guiding, informing and supporting employees in the fight against sexual harassment and sexist behaviour;
  • Health professionals (occupational physician or nurse) who have prerogatives in this area;
  • Management: manager of the team concerned or the N+2 or manager of another team;
  • CSSCT representatives, one of whose functions is to alert the employer to possible situations of RPS;
  • The Sexual Harassment and Sexist Behaviour referents in each Social and Economic Committee.

What types of reports does the system handle?


The system is intended to allow, among other things:

  • The collection of reports from the company’s employees and its subsidiaries regarding the existence of conduct or situations contrary to RTE’s anti-corruption code of conduct, in accordance with Article 17 of the Sapin 2 Law.
  • The collection of reports from any natural person who reports or discloses information concerning a crime, an offence, a threat or harm to the general interest, a violation or an attempt to conceal a violation of an international commitment duly ratified or approved by France, a unilateral act of an international organisation taken on the basis of such a commitment, European Union law, a law or regulation. Where the information was not obtained in the course of professional activities, the whistleblower must have had personal knowledge of it.
  • The collection of reports from any person concerned who reports the existence or realisation of risks to human rights and fundamental freedoms, the health and safety of individuals or the environment.

Who can use the system?

The individuals who may use the professional alert system are RTE employees and those of its subsidiaries, as well as, under the "Sapin 2" law, "external and occasional collaborators," and under the law on due diligence, employees of RTE’s subcontractors, suppliers, and subsidiaries.


They must act in good faith and without financial direct consideration..

How to Submit a Report

If you wish to submit a report, click on the "Submit an alert" button located at the top left of our homepage.


If this is your first time logging in, the notification process consists of four steps:


First, you should read the information regarding the protection of your identity’s confidentiality and answer a security question (the "captcha").


On the next page, provide the domain relevant to your alert.

Then, write your alert message or information request and respond to the questions using the predefined answers. In the free text fields, provide the facts, information, or documents in any form or format that support your report, if you have such elements.


After submitting your message, you will receive a reference number, which serves as the acknowledgment of your alert or information request.


Finally, configure your personal and secure dialogue box. The relevant contact will use it to respond to your questions and keep you informed, if necessary, about the progress of your alert’s processing.


If you already have a secure dialogue box, you can directly access it by clicking on the "Log in" button. Please note that before entering your alert message, you must also answer the "captcha."


Important: Unless you explicitly allow the relevant contact to reach you through another means you have specified, they will only respond through this platform. In that case, if you wish to be informed about the follow-up to your alert, you must create a secure dialogue box and consult it as needed.


Who Handles the Report?

Upon receipt of the report, depending on its type, the relevant contact person (Sapin 2, duty of vigilance, or psychosocial risks) informs the whistleblower of the reasonable and foreseeable timeframe required to examine the admissibility of the report (i.e., verifying that the report meets legal and regulatory requirements) and the procedures through which the whistleblower will be informed of the outcome of their report.

RTE's management conducts a verification of the facts, possibly involving an external expert.

The individuals in charge of the verification have access only to the information necessary to carry out their mission and are bound by strict confidentiality in accordance with the ethical rules governing the verification process.

What Guarantees Are Provided to a Whistleblower Acting in Good Faith?

A whistleblower acting in good faith is entitled to several guarantees:


Confidentiality

The system ensures the strict confidentiality of the whistleblower's identity, the identity of the individuals implicated in the report, and the documents and information disclosed. This confidentiality extends to any communication with third parties when such communication is necessary solely for the purposes of verification or processing the report.


Identifying elements concerning the whistleblower cannot be disclosed, except to judicial authorities, and only with their consent, once the validity of the report has been established. This identity, in particular, cannot be revealed to the persons potentially implicated, even if they request access to the findings of the verification report concerning them.


Protection Under the Labor Code

Any individual who uses RTE's professional whistleblowing system in good faith is protected under the second paragraph of Article L.1132-3-3 of the Labor Code (introduced by the law of December 9, 2016). This protection ensures they cannot be excluded from recruitment processes, access to internships, or professional training opportunities. They also cannot be sanctioned, dismissed, or subjected to direct or indirect discriminatory measures, particularly regarding pay, bonuses, stock distribution, training, reassignment, job classification, promotion, relocation, or contract renewal.


Risks of Improper Use of the Whistleblowing System

Misusing the whistleblowing system in bad faith, including filing reports with the intent to harm the reputation of individuals or entities or submitting knowingly false reports, may expose the whistleblower to disciplinary actions and legal proceedings for defamation.

What Is the Personal Data Protection Policy?

The amended French Data Protection Act of January 6, 1978, and the European Regulation No. 2016/679/EU of April 27, 2016 ("GDPR") form the legal framework applicable to the processing of personal data. These texts notably impose various obligations regarding the protection of employees' data and the obligation to inform them about the processing of their personal data.


A "personal data" refers, under the applicable regulations, to any information relating to an identified or identifiable natural person, where such identification can be made directly or indirectly (in other words, data that could identify a natural person when combined with other data sources, such as an identification number or other elements specific to the individual).


To determine whether a person is identifiable, all means reasonably available to the data controller or any other person with access to the data must be considered.


The person concerned by the processing of personal data is the one to whom the data being processed relates.


The term "processing" generally refers to any operation or set of operations performed, whether by automated means or not, on personal data or sets of personal data.

Under the legal framework outlined above, any concerned person has the right to access, rectify, oppose, port, limit, or erase their data, or withdraw their consent regarding the processing of their data.

For further information, concerned persons can also consult the website of the French Data Protection Authority ("CNIL"). Additionally, they can file a complaint with the supervisory authority under the conditions provided by the applicable regulations.

To know

Each alert has its own confidential and secure system for sending and receiving messages.


These exchanges respect your choice if you wish to remain anonymous. In this case, you are advised to avoid including in your report any elements likely to identify you.


Only the designated referees will receive the information you send us via the form. You will be able to track your report and communicate with the referee(s) using the confidential code generated by the platform when you submit your report.


All reports will be carefully analysed and processed.
